Last updated: 2nd October 2026

These terms apply when you use our website or engage us for services. Please read them carefully.

1. Who We Are

G’Day Broadcast Pty Ltd (“we”, “us”, “our”) is a digital marketing agency based at Kyle Rd, Altona North, Victoria. We provide SEO, Google Ads, Meta Ads, social media, content marketing, web development, UI/UX design, landing pages, reporting and account management services. Our work is delivered by our team in Australia and our team in India.

“You” means the person or business using our website or services. “Website” means gdaybroadcast.com.au.

2. Agreeing to These Terms

You accept these terms when you use the Website, sign or accept a proposal or quote from us, pay one of our invoices, or ask us to start work. Your proposal and these terms together make up our agreement. If they say different things, the proposal wins for that job.

3. Using our Website

You can browse our website for your own use. Please don’t copy our content, misuse the site or try to disrupt it. Information on the site is general only and isn’t advice for your business. We don’t promise the site will always be available or error-free. Links to other websites are for convenience only, and we aren’t responsible for their content.

4. Our Content and Intellectual Property

The text, images, graphics, logos, videos, designs and other content on the Website belong to us or our licensors and are protected by Australian copyright and other intellectual property laws. G’Day Broadcast” is a registered trademark of G’Day Broadcast Pty Ltd, ABN: 61 676 233 864.

You may view and print pages for your own personal, non-commercial use. You may not reproduce, modify, distribute or display our content without our prior written consent.

5. Enquiries, Audits and Quotes

Submitting an enquiry or form, or receiving a free audit or quote, does not create a contract. A contract is formed when you accept our written proposal, quote or service agreement, or otherwise accept these terms as set out in clause. Unless stated otherwise, quotes are valid for 7 days.

Free audits and recommendations are general in nature and based on the information available to us at the time.

6. Our Services

The work we do for you, the price and any minimum term are set out in your proposal or quote. Anything outside that scope is extra, and we’ll quote it before we start. We may make reasonable changes to how we deliver the work, as long as you still get what was agreed.

7. Fees and Payment

  • Monthly fees are invoiced in advance unless your proposal says otherwise.
  • Invoices are due within 5 days.
  • All prices are in Australian dollars and exclude GST unless stated.
  • Payment methods: credit card, debit card, bank transfer, direct debit. Card payments are processed by SquareUp.
  • If an invoice is overdue, we may pause work until it is paid.
  • Overdue amounts may attract interest at the rate set under the Penalty Interest Rates Act 1983 (Vic).
  • You’ll pay our reasonable costs of recovering overdue amounts, including debt collection and legal costs.
  • If you think an invoice is wrong, please tell us within 5 days of receiving it so we can sort it out. Please keep paying any undisputed amounts.
  • Our fees are for the work we do, not for specific results, so they are payable whatever the results.
  • We may change our fees with at least 30 days’ written notice. If you don’t accept a change, you can end the services before it starts, without paying for any remaining minimum term.

8. Ad Spend and Budgets

Advertising costs (for example Google or Meta) are separate from our fees. You pay them directly to the platform, and you are responsible for all charges the platforms make to your account.

We won’t increase your budget without your approval. Platforms may sometimes spend slightly over a daily budget, and that is outside our control. We’ll tell you before incurring any significant third-party cost on your behalf (such as domains, hosting, plugins, licences or stock assets).

9. Minimum Term, Pausing and Cancelling

Ongoing services

  • If your proposal includes a minimum term, fees apply for that full term. [CONFIRM: see note on website “no lock-in” claim.]
  • After the minimum term (or if there is none), either of us can end the services with 30 days’ written notice. Email is fine.
  • Because monthly fees are paid in advance, we recommend giving notice before your next billing date so you aren’t charged for another month.
  • If you want to pause services, please ask us in writing. Any pause needs our agreement and may extend your minimum term.

If we cancel

We may end the services straight away if you don’t pay, break these terms, or ask us to do something unlawful or against platform rules.

Refunds

Fees already paid are not refundable, except where the law requires it or where we haven’t delivered a service you’ve prepaid for.

10. When Services End

  • You pay all fees owed up to the end date.
  • We’ll hand back your accounts, files and assets within 14 days, as long as your account with us is paid.
  • We’ll remove our access to your accounts and stop any related automations or scheduled messages.
  • We may keep copies of records where the law requires it or for our own records.

11. Results

We’ll always do our best work, but search engines and ad platforms control their own systems and change them often. We can’t guarantee rankings, traffic, leads, sales, return on ad spend or any other specific result.

Timeframes (for example, seeing SEO improvements in 6–12 weeks) and any forecasts we give are estimates only, unless we expressly agree otherwise in writing.

12. What We Need From You

  • Accurate information and timely access to your accounts, website and assets
  • Prompt feedback and approvals. Delays on your side may delay results
  • Telling us about any legal or industry rules that apply to your business, for example health, NDIS, finance, legal or alcohol advertising rules

13. Approvals and Content

  • Once you approve ad copy, creative, pages or posts, that approval is final, except for errors made by us. You are responsible for approved content.
  • You confirm that content you give us (logos, images, text, customer data) is yours or that you have permission to use it.
  • You are responsible for making sure your products, offers, prices and claims are true and lawful.
  • We may refuse or remove content that we believe is unlawful, misleading or against platform rules.

14. Accounts, Data and Ownership

  • Ad accounts, analytics, your website and your social pages belong to you. Where possible they should be set up in your name, with us added as a user.
  • Your data and campaign results belong to you.
  • Content and creative we produce for you becomes yours once you’ve paid for it in full.
  • We keep our own tools, software, templates, methods and know-how.
  • We may show your logo and general results in our portfolio unless you ask us not to.

We may use our team in India, freelancers and other subcontractors to deliver your services. Everyone who works on your account is bound by confidentiality. We remain responsible for their work under these terms.

17. Third-party Platforms

We rely on platforms like Google, Meta, LinkedIn, Shopify, WordPress and hosting providers. Those platforms have their own terms, and we don’t control them. We are not responsible for their outages, policy changes, ad disapprovals or account suspensions, but we’ll help you work through them.

18. Confidentiality

We’ll keep your business information confidential and only use it to deliver our services, unless the law requires us to disclose it. We may share it with contractors and service providers who help us deliver the services and are bound to keep it confidential. Please do the same with our pricing, proposals and methods.

19. Privacy

We handle personal information in line with our Privacy Policy. If you give us your customers’ personal information, you confirm you have collected it lawfully and have permission to share it with us, including for us to handle it with our team in India and our service providers.

20. Automated Messages, SMS and Email

We use automation tools (currently GoHighLevel) to manage enquiries and communications.

  • Consent. If you submit a form, request a call-back, or give us your mobile number or email address in connection with an enquiry or booking, you agree that we may send you related automated messages, such as enquiry acknowledgements, missed-call text-back replies, appointment reminders and follow-ups. 21. Hiring our team

While we work together and for 12 months afterwards, you agree not to directly hire or engage anyone from our team or our contractors who worked on your account, without our written consent.

22. Australian Consumer Law

Our services come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these terms excludes, restricts or modifies any right or remedy you have under the Australian Consumer Law or any other law that can’t lawfully be excluded. If you’re entitled to a remedy, we’ll provide it.

23. Our Liability

We are not liable for indirect losses, such as lost profits, lost revenue or loss of data; and

24. Your Responsibility for Claims

You agree to cover our reasonable losses and costs from a third-party claim, to the extent the claim is caused by content you supplied or approved, your products or claims, or your breach of the law or these terms. This doesn’t apply to the extent the loss is caused by our own negligence or breach.

25. Events Outside Our Control

We aren’t responsible for delays or failures caused by things outside our reasonable control, such as platform outages, algorithm changes, internet or power failures, natural disasters or government action.

26. Disputes

If something goes wrong, please contact us first so we can try to fix it. If we can’t resolve it within 30 days, either of us may refer it to mediation with a mediator agreed between us (or nominated by the Resolution Institute). If mediation doesn’t resolve it, either of us may start proceedings in the courts of Victoria. Either of us can seek urgent court relief at any time.
